Dispute Resolution for the financial industry
EuroArbitration is a leading organisation in the field of financial dispute resolution. The dispute resolution mechanisms developed by EuroArbitration (Arbitration, Mediation, Expertise and Evaluation) have been conceived specifically for financial disputes between professionals, corporations and institutions in a national and international context.
Litigation not always suitable
Disputes in the financial sector pose unique difficulties and challenges. Financial disputes often concern complex factual and legal issues. Often, the parties will be of different nationalities, with different linguistic, legal and cultural backgrounds. They may also have quite different expectations about how a dispute can be resolved reasonably and fairly. There may be a lack of trust accompanied by uncertainty about the route to follow. These difficulties may be compounded by distance and the disadvantages one party may face in participating in proceedings on the other's home soil. Indeed, court victories may be Pyrrhic because, in many cases, they cannot be easily enforced against assets abroad. For all these reasons, national courts in the country of one of the parties may not appear suitable to the other parties. Negotiation, without the threat of effective legal sanctions, or the assistance of a seasoned neutral third party, may also be a weak or ineffective alternative.
An Effective Alternative
EuroArbitration offers financial actors, sophisticated binding and non-binding forms of dispute resolution, as an effective alternative to court litigation or unassisted negotiation. Sophisticated parties may even be able to combine court litigation with these mechanisms.
